Box 449 Natural Resource Trustee <br />Florence, CO 81226 <br />RE: NOV CV-2004-003 <br />Southfield Mine, Permit No. C-81-014 <br />Dear Mr. Patterson: <br />The Division of Minerals and Geology has reviewed the correspondence received via <br />FAX on Sept 29, 2004 concerning Notice of Violation CV-2004-003 for the Southfield <br />Mine. The Division is not in favor of a revision to revise the seed mix back to the seed <br />mix predating March 2002. Changes in the seed mix were agreed upon after lengthy <br />review of a number of revisions to the permit. These revisions were specific to the <br />landowner's wishes concerning the reclamation that was imminent following closure of <br />the Southfield Mine. Reasons for the replacement of two aggressive introduced <br />species of grasses with two native species on the Corley property were considered prior <br />to the agreement and approval of the current seed mix. The Division is pleased to <br />understand that the landowner W. D. Corley, Jr., is not upset that the un-approved seed <br />mix was used. The information you submitted will be included in the file for review <br />during the penalty assessment phase for the NOV. <br />Please submit the plan to interseed the approved mix and include written <br />documentation demonstrating that each species of the approved seed mix was, or will <br />be, seeded at the approved rate (PLS/ft2). Refer to Step 1 of the steps necessary to <br />abate the NOV. The Division has extended the abatement deadline to Friday October <br />8, 2004 at 5:00 pm.
