Banta. <br />Division Director <br />Enclosed please find an extension of time for abatement of the <br />above referenced Notice of Violation. Step one of the required <br />abatement called for submittal of a revised reclamation plan for <br />the mine bench by December 23, 1991. Mr. Greg Lewicki submitted <br />information indicating that the highwall at the mine may have been <br />in place prior to August 3, 1977 by the required abatement date. <br />The Division has reviewed the material submitted by Mr. Lewicki and <br />the Colorado regulations regarding reclamation requirements for <br />"pre-law" highwalls. Our findings from these reviews are not yet <br />conclusive. Therefore, the abatement due date for the NOV is being <br />extended. American Shield responded to step one of the required <br />abatement in a timely manner by submitting information prior to <br />December 23, 1991. <br />We plan to discuss our findings on the information submitted with <br />Mr. Lewicki later this week.
