Shelton <br />Director <br />September 2', 1981 <br />Mr. Chuck Webster <br />Webster Sand and Gravel <br />400 E. 4th Street <br />Leadville, Colorado 80461 <br />RE: Webster Sand and Gravel Unpermitted Operations in Lake County <br />NOTICE OF FORMAL PUBLIC HEARING <br />Dear Mr. Webster: <br />On January 28, 1981, the Mined Land Reclamation Board moved to issue a <br />Notice of Violation for mining without a permit and a Cease and Desist <br />Order for your sand and gravel operation located in approximately the <br />SW>: of the NEB and the NWT of the SEi of Section 16, Township 9 South, <br />Range 80 West of the 6th P. M, in Lake County. Consideration of civil <br />penalties in this matter were deferred until a later date. Since that <br />time, no application fora ll2 permit application for this operation has <br />been received by this Division from Webster Sand and Gravel. <br />On August 31, 1981, reclamation specialist James McArdle and 1 inspected <br />the operation mentioned in the previous paragraph as well as another <br />Webster Sand and Gravel operation located in approximately the NE>< of <br />Section 20, Township 8 South, Range 80 West of the bth P. M. in Lake <br />County. This operation is estimated to be about 60 acres or more in ex- <br />tent. This second operation (like the first) has not been permitted <br />under the Colorado Mined Land Reclamation Act. There was evidence of <br />extensive excavation, product stockpiling and loading, and water impound- <br />ment on the site. There was no evidence of topsoil stockpiles on the <br />site. <br />During the inspection of the first operation (the one having a Cease and <br />Desist Order), it was evident that stockpiled topsoil had been removed <br />from the site. About 800 cubic yards of topsoil had been removed from <br />a site near the southwest edge of the pit. <br />All mining operators including sand and gravel operators are required to <br />obtain mining and reclamation permits for their mining operations in <br />Colorado by the Mined Land Reclamation Act, C.R.S. 1973, 34-32-101 et sec <br />and specifically, 34-32-109(7), as amended. <br />
