Box 616 Iame55 Lnchhmd <br />Oak Creek, CO 80467 t.ee°"veo""'°' <br />m~chael B Lonq <br />Drvnion Director <br />RE: Bear River Pit, Permit No. I1M-86-040, Notice of Possible Violation for Failure to Post Adequate <br />Financial Warranty <br />Dear Mr. Crawford: <br />On November 10, 1997, the Division of Minerals and Geology conducted an inspection of your operation and <br />found the following: that at this time theadditional required bond of $31,350.00 has not been submitted to the <br />Division of Minerals and Geology (DMG); and, alternatively, performance of reclamation work to bring the <br />reclamation liability under the currently posted bond has not been completed by the formerly imposed due <br />date of February 11, 1998. <br />We believe this is in violation of: C.R.S. 34-32.5-117(4)(b)(I), for failure to keep a financial warranty <br />adequate to complete reclamation of a permitted site. Therefore, we have reason to believe that a violation <br />exists to Permit Number M-86-040 and to the Law, and have scheduled this matter before the Mined Land <br />Reclamation Board. <br />A Formal Public Hearing will be held at the March 25-26, 1998 Board meeting, for consideration of possible <br />violation. The hearing will be held in Room 3l8 of 1313 Sherman Street, Denver, Colorado, beginning at <br />9:00 a.m. or as soon thereafrer as the matter can be considered. At that hearing you will have the <br />opportunity to be represented and heard. It will be reiterated that there is reason to believe that you are in <br />violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist order, assess a Civil Penalty in <br />the amount of $[00.00 to $1000.00 for each day of violation, or order the permit be suspended, modified, or <br />revoked. In addition it may set the matter for consideration of forfeiture of the current $9,150.00 financial <br />warranty at a subsequent hearing.
