As you all know, from <br />our letter dated May 9, 1985, which is enclosed, I am the culprit <br />who ask for the Mined Land Reclamation Board investigation and in- <br />spection of our pit. Many months previous I realized the fact that <br />our lessee (Brinkmann-Woodward) was operating under conditions not <br />in conformance with the rules and regulations governing our operation <br />as set up by the Mined Land Reclamation Board. I do appreciate your <br />concern in issueing the cease and desist order and since Lawrence <br />Construction Company has the permit and since we are the operator we <br />do realize the order is against us. So, at the time you decide the <br />civil penalty I would appreciate if you would be as lenient as poss- <br />ible, since we were also trying to stop an operation that was illegal. <br />As far as the removal of top soil is concerned, we were hauling out <br />pit run gravel and the loader operator inadvertently dug into the <br />stockpile of topsoil. This pile was not strictly topsoil but very <br />dark sandy granular material.
