The application was
called complete on November 7, 2002 and the decision date is February 5, 2002. The
pre-operational inspection was conducted on December 8, 2003.
The application was substantially adequate as submitted, however, there are a few minor
items that will require additional clarification and or submittals before a decision can be
rendered. They aze as follows.
Map C-2 {mine plan/reclamation plan) identifies the proposed addition for the
ski lake as being an isolated permitted azea that is connected to the southwest
parcel via a slurry pipeline. However, the area where the pipeline connects
the new addition to the existing pem3itted azea is not included in the proposed
permitted area. Rule 1.1 identifies affected area, among other things, as lands
where facilities, equipment, tools, machines or other material or property
which result from or are used in such operations aze situated. The proposed
flexible pipeline connecting the ski lake to the southwest pazcel crosses a
small area that is not included within the permit or affected azea boundary.
This area must be included within the affected area boundary. Please revise
the map accordingly.
2. Attached are the State Engineer's Office comments. Please contact them for
further clarification on their comments.
This concludes the preliminary adequacy review. We aze still evaluating the proposed
reclamation liability and grill notify you with any concerns.
