As discussed, CYCC <br />proposes the use of the existing sluice-gate to maintain the pond <br />level at a point which allows for the treatment and conveyance of <br />the 10 year-24 hour storm event. The existing flume installation <br />would be utilized in tracking flows per the current NPDES permit, <br />and the approved NPDES compliance sampling point would not require <br />modification. <br />We wish to reiterate that it is CYCC's position that spring run-off <br />volumes in excess of designed routings should not be subject to <br />enforcement action, and that we feel the referenced violation which <br />was issued stemmed from such an event. <br />Should you have any questions or comments, please contact me at <br />your convenience. <br />Sincerely, <br />Marcus A.
