Banta, <br />Division Director <br />On March 28, 1991, we received the above-referenced TDL No. X-91-02-244-1 TV1, <br />The document indicates that the Twentyrrile Coai Company, Foide7 Creek Mine, <br />Permit No. C-82-056 is deficient in its treatment of small area exemptions, <br />Small area exemptions located at the Fish Creek Bore Hole, the rock dust tank, <br />and the Sandstone power substation are referenced, <br />The drainage control features in place at these areas were approved by this <br />Division, and the systems have been functioning properly. We do acknowledge, <br />however, that the structures were approved without the demonstration required <br />by our Rule 4,05.2(3)(a). We propose to remedy the situation as follows. <br />A letter will be sent to Twentymile Coal Company. The operator will be <br />required to submit a minor revision, no later than April 30, 1991, which <br />provides demonstrations, pursuant to Rule 4.05,2(3)(a), for all small area <br />exemptions located at the Foidel Creek Mine. The minor revision will be <br />approved within the 10 day timeframe required by our regulations. <br />Please feel free to contact us with any questions or concerns.
