Long <br />orvision o~re~r~r <br />RE: Mid-Continent Quarry, Permit M-82-121, Request for time <br />extension to submit Financial Warranty and consideration of <br />reasons to determine that a Reason to Believe a Violation <br />Exists is not justified. <br />Dear Ms. Delaney: <br />The Division has reviewed your letter of July 23, 1996, <br />requesting a time extension to submit additional financial <br />warranty for the Mid-Continent Limestone Quarry. We have also <br />received and reviewed Robert Delaney's correspondence dated <br />August 16, 1996 stating the reasons why he believes that the <br />Division determination that a violation may exist is incorrect. <br />After considering the outstanding issues, including the current <br />situation with the EPA regarding the possible hazardous waste <br />spill at the site and the negotiations between MC Resources and <br />BLM, the Division is extending the time to attempt to resolve the <br />financial warranty situation. Please note, however, the Division <br />does not consider the situation resolved and reserves its right <br />to ask the Mined Land Reclamation Board (NLRB) to consider <br />possible revocation of the permit and to take other appropriate <br />actions. We anticipate asking the NLRB to consider this issue at <br />their November 13-14, 1996 Meeting. <br />In response to Robert Delaney's August 16, 1996, letter, the <br />provision of the liquidation plan which refers to negotiation of <br />a reclamation schedule applies only to the coal mine site; it has <br />no application to the quarries. Section 4.3.4 refers to the <br />"reclamation plan." Reclamation plan is defined by the <br />liquidation plan as the plan for the coal mine site. <br />Consequently, reference to negotiation does not apply to the <br />quarries. <br />
