The violation was issued October 16, 1995. The first 90 day period ended <br />January 14, 1996. The violation abatement due date has been extended to April 13, 1996, then to <br />July 12, 1996, October 10, 1996, December 9, 1996, Mazch 9, 1997 and finally to June 7, 1997. <br />Abatement requirements for the violation included submittal of a technical revision (TR), and field <br />implementation of the designs approved in the TR following final approval by DMG. The revision <br />was approved on August 26, 1996. Seneca has initiated work on the abatement plan by removing <br />topsoil over the area which needs to be regraded. Seneca still needs to reduce the slope back to a 3:1, <br />replace the topsoil and revegetate the redisturbed acreage. Some additional drainage work is also <br />required. Because of the weather and ground conditions at the site, the work is not complete. <br />Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension of the <br />abatement of deadline beyond 90 days. The technical revision addressing the new reclamation plan <br />was issued in the middle of September. Weather and ground conditions have also delayed <br />reclamation of this area.
