It is also my understanding <br />that EFMC has worked with the Coal Program staff to develop a revised reclamation plan (via <br />Minor Revision No. 17) for the area of the Raton Creek Mine that was the subject of the Notice of <br />Violation. Based upon the facts presented in the December 13, 1999 letter, and based upon the <br />revised reclamation plan approved under MR-17, I hereby vacate Notice of Violation CV-1999-O14. <br />To avoid future enforcement issues, please ensure that the work approved under Minor Revision <br />No. l7, is completed within the timeframes now specified in the permit. <br />Thank you for your cooperation. <br />Sincerely, <br />Michael B.
