In your January 11, 1993 letter to the Division you <br />requested any reports or information concerning full compliance of Elbert County, the <br />operator regarding NOV M-91-086. Long <br />Division Dlreaor <br />2) Failure to protect areas outside of the affected area from damage as required <br />by §34-32-116(7)(h). <br />3) Construction of unpermitted road crossing in violation of the provisions of <br />the permit as part of the remedial action the County was ordered by the <br />Board to do the following: <br />al By November 1, 1991 regrade, repair and commence revegetation of <br />the buffer zone and berm located above, and immediately adjacent to, <br />the East bank of the affected reach of Spring Branch gulch. The <br />berm shall have a 3:1 or gentler slope, and together with the buffer <br />zone, shall be a minimum of 25 feet in width. <br />bl By November 15, 1991, seed and mulch the buffer zone. <br />cl By October 1, 1991 submit a complete and adequate application to <br />the Division for a mine access road crossing over spring Branch <br />Creek. <br />d) By June 31 , 1992 remove the culverts from the previous mine access <br />road crossing and all fill from the previous mine access road crossing <br />that was deposited in the creek bed on the permit area and within <br />200 feet of the permit boundary to the extent that such material can <br />
