Lung <br />Division Director <br />NOV No. C-93-101 was issued to the Southfield Mine following a <br />partial site inspection on June 28, 1993 for "failure to display <br />mine/permit ID signs at each entrance to the permit area from a <br />public road, failure to clearly mark all areas affected by surface <br />operations and failure to maintain topsoil marker." <br />Seriousness: The mine ID sign was improperly placed down the road <br />and moved by June 30, 1993 to the proper location. The extent of <br />damage was therefore minimal and the duration between citation and <br />abatement less than 48 hours. <br />The perimeter markers were absent from the northwestern corner of <br />the disturbed area to the south, encompassing 1800 feet of the <br />western permit boundary. The remaining missing markers were in <br />between marked perimeters and averaged between 200-400 feet in <br />missing distance marked. The amount of impact was the same as <br />extent of violation. <br />The topsoil marker had fallen down from its post on the topsoil <br />pile furthest north on the western side of the refuse pile. <br />The seriousness of the violation is low to moderate. <br />Fault: Lack of diligence and maintenance by the operator <br />regarding the perimeter markers is asserted, while the mine ID sign <br />may be a lack of diligence on both the operator and the Division <br />since this was the first time the signage error was recognized. <br />The Division, once recognizing the error, immediately noticed the <br />violation during the inspection. The topsoil sign is a maintenance <br />issue and due to a lack of diligence by the operator. <br />Good Faith: There has been no extraordinary effort to abate this <br />violation by the operator, however, the mine ID was corrected <br />immediately and steps to abate the perimeter marker and topsoil <br />sign have taken place (see letter enclosed from EFCI dated July 15, <br />
