STATE OF COLORADO
DIVISION OF MINERALS AND GEOLOGY
Department of Na[ural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
January 20, 2005 '~
Deb Rudibaugh
711 Ranch
Parlin, CO 81239 / /
v V
RE: Rudibaugh Pit, Permit No. M-1995-057, AM-01 Information Request.
Dear Deb:
COLORADO
D1V ISiON OF
MINERALS
GEOLOGY
RECLAMATION•N ININC
SAFETY•SCIEN CE
Bill Owens
Governor
Russell George
Executive Director
Ronald W. Cottony
Division Direcor
Natural Resource Trustee
As promised, I will be helping you through the process of submitting the amendment to correct the
additional area of mining that has taken place. I requested that the Denver Office forward to me your
application so we can address it together. This will allow better communication between us and
hopefully less aggravation.
First, please submit a separate release request for the 2.01 acres per Rule 4.17.1. I have enclosed a
copy of the Rule for your reference. Your release request should note that the area being released has
not been disturbed by mining activities.
Secondly, please find enclosed a letter that Denver prepared on my behalf that notes what is required for
an application to be considered complete for review. The best advice I can give here is to go through the
Exhibit Requirements and if nothing has changed, simply state "Please refer to Approved Permit Exhibit
.., no changes anticipated." This may seem redundant, but it eliminates any questions from outside
entities if questions arise. A review of the file shows that I have the original maps and one made from
GPS readings by myself. But I do not have one as I thought showing any changes. Please make a copy
of the original Mining and Reclamation Maps and note areas to be added and removed. Hand drawn
notations will be fine. If, as we discussed, you wish to change reclamation plans, the new map should
denote those changes as well.
By Rule you have 60 days to return this information to this Office. If the information is not received by
March 14th, 2005, you will forfeit your amendment fee and the application will be denied. This will put us
back in the position of going before the Board and I've been instructed to correct this issue one way or
another. Please do not delay in getting back to me.
If you need additional information, please contact me at the Division of Minerals and Geology, Grand
Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, telephone no.
970.241.1117.
Sincerely,
G. Russell Means
Environmental Protection Specialist
Office of Office of Colorado
