Box 445 <br />Telluride, CO 81435 <br />Re: Alexander Pit (Permit M-76-032) Reason to Believe Violations Exist <br />Dear Mr. Bennett: <br />On April 1, 1993 we conducted an inspection of your mine and found: <br />A failure to post an accurate identification sign for the mine and failure to <br />?dPqu?.teiy mark the boundaries of the permitted affected area which had been <br />identified ds problems during an inspection cor!duc~ed August 19, 1992 for which <br />corrective actions had ben required by October 26, 1992. We believe this is in <br />••iolation cf P.ule 6.7 of the Mineral Rules and Regulations of the Colorado Mined <br />Land Reclamation Board. <br />Therefore, we have found reason to believe a violation exists to Permit M-76-032 and <br />the Law and have scheduled this matter before the Mined land Reclamation Board. <br />A Formal Public Hearing will be held during the May 26-27, 1993 Board meeting for <br />consideration of possible violation. It will be reiterated that there is reason to believe that you are in <br />violation of the provisions noted abov?. <br />If the Board finds a violation at this hearing, it may issue a cease and desist <br />order, assess a civil penalty in the amount of 8100.00 to 31,OOO.CO for each day of <br />violation or order the permit be suspended, modified or revoked. in addition it may <br />set the matter for consideration of forfeiture of the 840,000 financial warranty at <br />3 SUbSequeni hearing.
