The pond <br />inspection requirement has changed to a quarterly requirement; see the <br />attached Rule 4.05.6(13). Consequently, the 1989 MR-7 to modify the pond <br />inspection frequency to a semi-annual requirement is no longer in force. <br />have also enclosed a copy of the current water monitoring plan. <br />Rockcastle has fifteen days from receipt of the violations to submit <br />information identifying exceptional circumstances associated with the alleged <br />violations. Upon receipt of a proposed civil penalty, Rockcastle has another <br />ten days to request an assessment conference, The Division will fix the <br />penalty, if no request for an assessment conference is received, Please <br />review Rules 5.03 and 5.04 for additional clarification on the violation and <br />civil penalty procedures. <br />
