Eazlier today, I telefaxed to you the Application for <br />Review and Application for Temporary Relief which were filed in the Office of Hearings and <br />Appeals today and mailed to the Regional Solicitor and to your office on June 4, 1994. <br />In addition to advising you of these actions, the purpose of this letter is to request <br />extensions of the interim and final abatement dates of June 6 and July 25, 1994, respectively, set <br />forth in the NOV. Kerr requests that those dates be extended to at least July 20 and .August 23, <br />1994, respectively. <br />The reason for an extension of the June 6 deadline for commencement is that it would be <br />impossible to assemble the equipment and workforce to begin the abatement action by that time. <br />The attached letter from Wagner Equipment Company demonstrates that the equipment needed <br />for abatement will not be available before mid-luly, and possibly not even then. Kerr would also <br />have to assemble a workforce of qualified equipment operators, which is not readily available <br />because of the remote location of the Mine. That took several months for the backfilling and <br />grading Kerr performed last yeaz and required hiring operators from as faz away as Grand <br />Junction and Pueblo. Finally, Kerr would have to discuss with the DMG whether a permit <br />i~as~. ae.v~ <br />
