A notice of assessment was <br />received by GVC on October 15, 1994. The assessment failed to grant <br />any good faith credit for the extraordinary effort that GVC <br />exhibited in rectifying the problem. This letter and the enclosed <br />form will formalize the arrangements that you have coordinated for a <br />telephone conference at 9:30 AM on Wednesday November 2, 1994. <br />As you are aware, the bulk of the problem was failure to identify <br />surface water controls at the site in the permit document. These <br />controls are also shown on the revised Figure 2.2-4 that was given <br />to you on September 22, 1994 before you had even written the <br />citation. To enhance the controls at the mine bench a water bar was <br />designed and permitted. GVC made the revision to the surface water <br />controls the morning after you phoned to inform me that the revision <br />was approved. This new system will also ensure that these controls <br />will be more apparent on the ground. <br />There are other general facts that apply to both areas. The areas <br />have existed in this form since 1977. No other inspection has <br />revealed that there was a problem with the controls. This includes <br />both DMG and OSM inspections. This failure does not exempt the <br />operator from its responsibility, but does indicate that the areas <br />in question are insignificant when compared to the overall system. <br />Please call if there are questions or if I can be of assistance. <br />S'ncerely~,, <br />ohn M.
