Box 6 <br />Barbourvile, KY 40906 <br />RE: Letter of August 24, 1992, Trinidad Basin Mining Company, <br />Trinidad Basin Mine, Permit No. C-81-048 <br />Dear Mr. Mills: <br />On August 31, 1992, we received your letter regarding your recent problems at <br />the Trinidad Basin Mine. We would like to take this opportunity to describe <br />our procedures for filing appeals to Notices of Violation. <br />The first step will be discussions between Trinidad Basin Mining and the <br />Division. These discussions will be held during an Assessment Conference <br />scheduled for September il, 1992. During this conference, the Division and <br />your representative will discuss the facts and issues in the case. An <br />Assessment Conference Officer will then decide ~.vhether to vacate the <br />violations or implement them. <br />Should tnere be ami dissatisfaction ,vith the outcome of the A<.sessment <br />ConFerence, you ~,aill still have an opportunity to request a Formal Public <br />Hearing before the Coloraco Mined Land Reclamation Board. <br />Snouid you have any questions regarding your appeals process, please contact <br />me. <br />Sincerely, <br />,; 1,. <br />Daniel I.
