You aze well-acquainted with the facts underlying <br />the NOV. Mountain Coal continues to be particularly concerned with the allegation in the NOV <br />that Mountain Coal failed to salvage topsoil at the development waste pile site. <br />Mountain Coal requests that the Division reconsider the basis for the topsoil allegation in the <br />NOV, and vacate that portion of the NOV for reasons stated in Mountain Coal's previous letters <br />to the Division.
