Long, <br />Division Director <br />Board of County Commissioners <br />Baca County <br />741 Main St <br />P 0 Box 116 <br />Springfield, CO 81073 <br />Re: Gravel Pit No 17, Permit No. M-81-138, Annual Fee and Report, Notice of <br />Violation No. M-93-040 <br />Dear County Commissioners: <br />C.R.S. 34-32-116(3) and (4), and Permit No. M-81-138 require Baca County to submit <br />an annual fee and an annual report on or before July 24 of each year. As of this <br />date, the Division of Minerals and Geology (the "Division") has not received Baca <br />County's annual fee of $225.00 and report for July 25, 1992 through July 24, 1993. <br />Therefore, Baca County is in violation of the above cited statutes and the <br />provisions of Permit No. M-81-i38. Also, be aware that no new permits for mining <br />operations shall be granted to Baca County (C.R.S. 34-32-120) until the violation <br />is abated with the State of Colorado. Pursuant to C.R.S. 34-32-124(7), as amended, <br />Baca County is hereby assessed a civil penalty in the amount of $225.00. <br />If Baca County fails to submit the annual fee, annual report, and the assessed <br />civil penalty by November 30, 1993, this matter will be scheduled for Formal Public <br />Hearing before the Mined Land Reclamation Board for consideration of a Cease and <br />Desist Order at the December 15-16, 1993 Board Meeting. <br />IN ORDER TO AVOID A CEASE AND DESIST ORDER, PLEASE SUBMIT $225.00 FOR ANNUAL FEES, <br />$225.00 FOR THE CIVIL PENALTY (FOR A TOTAL OF $450.00), AND THE ANNUAL REPORT BY <br />NOVEMBER 30, 1993. <br />The Board Meeting will be he]d on December 15 and 16, 1993, in Room 318 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter <br />as the matter can be considered, and Baca County will have the opportunity to be <br />represented and heard. <br />If you have any questions, please contact Barbara Chiappone. <br />Sincerely, <br />MICHAEL B.
