AFO granted an extension to <br />the required response period because MLRD did not provide sufficient <br />information to AFO to render a written finding. <br />Correspondence and documentation was submitted to AFO on December 7, <br />1990, from MLRD regarding the request for additional information. The <br />evidence presented substantiates MLRD's initial response verifying that <br />the operator, in fact, prepared sketches showing the number of holes, <br />burden, spacing, delay patterns, and decking for the records on file for <br />the 3-year period preceeding the Office of Surface Mining Reclamation <br />and Enforcement's (OSM) oversight inspection. <br />AFO has reviewed the documentation provided in MLRD's final response to <br />the TDN. OSM concurs with MLRD's decision not to take enforcement <br />action based on that information.
