Long <br />Division D~reuor <br />Florence, CO 81226 <br />Re: Notice of Violation - CV-99-014 <br />Raton Creek Mine - C-82-055 <br />Dear Mr. Patterson: <br />We are in receipt of your letters dated February 14, 2000 and February 15, 2000, pertaining to the <br />above-referenced Notice of Violation. In response, we enclose an "Extension of Time for <br />Abatement ..." document which extends the abatement requirement for CV-99-014 to March 15, <br />2000. We also hereby acknowledge that Energy Fuels Coal, Inc. retains the right to request an <br />assessment conference regarding CV-99-014 at some future time. <br />We welcome an opportunity to meet with you in the near future to expedite final resolution of the <br />reclamation plan for the Raton Creek Mine. It is imperative that we reach a final resolution prior to <br />March 15, 2000, so that we may avoid the possibility that a "Failure-to-Abate" Cessation Order <br />would be issued. I appreciate that you have taken the time to discuss this situation with me, and I <br />am confident that we will come to an acceptable agreement. <br />DMG and EFCI personnel have, for some time now, discussed the need to improve the vegetation <br />and erosional stability on the south-facing five acre parcel, and all parties seemed to agree that this <br />would be best achieved by improving the growth medium on the slope. As has been discussed, and <br />documented over the last year, it appears that the existing cover of cicer milkvetch is not sufficient <br />to provide the required erosional stability on the 5 acre parcel. For this reason, additional work is <br />required as indicated both in the existing permit and as indicated by ground observations. As I have <br />indicated during our recent conversations, this violation was issued because there seemed to be little <br />or no progress occurring over the last year in either implementing the current permit requirement to <br />import topsoil, or to provide and implement an appropriate revision to the reclamation plan at the <br />Raton Creek Mine. <br />We are pushing for an expedited resolution so that work can be accomplished as soon as possible to <br />maximize the benefit of spring moisture, and to finish all ground work prior to the end of the first <br />
