C-81-048 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND BOARD ORDER <br />IN THE MATTER OF TRINIDAD BASIN MINING COMPANY <br />------------------------------------------------------------------------------- <br />This matter comes before the Colorado Mined Land Reclamation Board <br />("Board") upon a request by the Colorado Mined Land Reclamation Division <br />("Division") to forfeit the reclamation bond. The Trinidad Basin Mining, <br />Inc., a.k.a. Trinidad Basin Mining Company ("TBM") has responded with a <br />request for bond release. <br />FINDINGS OF FACT <br />1. On December 28, 1984, following a hearing, the Board issued an <br />order suspending TBM's permit and ordering it to complete all outstanding <br />reclamation activities at the Trinidad Basin Mine by July 31, 1985. <br />2. TBM has not performed all of the reclamation at the site. <br />3. The approved reclamation plan set out in TBM's permit provided <br />for reclamation fora post-mining land use of rangeland. Since that time <br />ownership of the property has been transferred, and the area is currently <br />being developed for homesites. The construction of homesites on backfilled <br />areas that have not been restored to a condition capable of supporting such <br />use presents a probable hazard to public health and safety. <br />4. Those portions of the site that have not been backfilled may <br />be suitable for residential post-mining land use. <br />
