Box 591 <br />Somerset, CO 81434 <br />Re: Notice of Violation CV-97-022 -West Elk Mine - C-80-007 <br />Dear Mr. Schmidt: <br />We have reviewed the materials dated July 24, 1998, in which Mountain Coal Company <br />requests that the above-referenced Notice of Violation be vacated. Based on our review of all <br />technical information submitted by Mountain Coal Company and gathered by the Division to <br />date, it appears that Mountain Coal Company has provided acceptable evidence that the West <br />Elk Mine is not the sole source of water discharging from the Edwazds Portal location. Mountain <br />Coal Company has also provided evidence that the water discharging from the Edwards Portal <br />did not cause the landslide located above the Bear Mine yard. For these reasons, I hereby vacate <br />Notice of Violation No. CV-97-022 <br />Thank you for your cooperation in this matter.
