WYMAN'S POSSIBLE PERMIT TERMINATION AND <br />FINANCIAL WARRANTY FORFEITURE FOR FAILURE TO PAY ANNUAL FEE AND <br />CIVIL PENALTIES AND FAILURE TO FILE ANNUAL REPORT, FILE NUMBER M- <br />1983-037 / <br />THIS MATTER came before the Mined Land Reclamation Boazd ("Boazd") on <br />November 17, 2005, in Denver, Colorado for a hearing to consider a possible permit <br />termination and financial warranty forfeiture for failure to pay annual fees and civil penalties <br />and failure to file an annual report. The file number in this matter is M-1983-037. There <br />were no appearances on behalf of Louis W. Wyman ("Operator"). James Dupler appeared <br />on behalf of the Division of Minerals and Geology ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />1. The Operator received a Section 110c sand and gravel permit in 1983. The Operator's <br />excavation activities aze located on 9.50 permitted acres in Section 17, Township 4 North, <br />Range 89 West, 6`h Prime Meridian, Routt County, Colorado. The site is known as the <br />Wyman Pit. The Operator submitted a bond of $5,000.00 to the Division to secure <br />reclamation of the site. <br />2. The Operator failed to file an annual report and failed to submit an annual fee of $281.00 <br />to the Division on or before May 31, 2005, as required by Section 34-32.5-116(3)(a) of the <br />Colorado Land Reclamation Act for the Extraction of Construction Materials, Section 34- <br />32.5-101 et seq., C.R.S.
