Cattany <br />(/ Division Director <br />RE: King Mountain Gravel, LLC., Permit No. M-1978-314; CN-O1 Natural Resource Trustee <br />King Mountain Sand & Gravel Mine; Adequacy Revi~,w <br />,I/ <br />Dear Mr. Eberl, <br />Listed below are adequacy review comments on the King Mountain Sand & Gravel Mine Conversion <br />Applical5on (CN-Ol), Permit No. M-1978-314. The Division of Minerals and Geology (Division) is <br />required to make an approval or denial decision no later than February 21, 2005, therefore, your response <br />to the following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. Please submit the proof of notice to all owners of record of surface lands, mineral owners, easement <br />holders, and owners of record of surface lands that aze within 200 feet of the boundary of the affected <br />land. Proof of notice may be rettun receipts of a Certified Mailing or by proof of personal service. <br />Rule 6.4.4 Exhibit D- Minin Plan <br />2. The application is not clear as to the location of the topsoil stockpiles that will be used for fmal <br />reclamation. Please state if the topsoil piles are all or a portion the 6' high screening berm used to <br />minimize the visual impacts of mining. The location of all topsoil piles will need to be depicted on a <br />map. 111 addition, please state if there will be any overburden piles and depict such piles on the <br />applicable map. <br />3. The screening berms have a proposed slope of 2h:ly and are 6 feet high. Please state the method in <br />which the piles will be revegetated given the steep slopes and how they will remain stable for the <br />extent of mining. In addition, please state the distance from the toe of the visual berms to the county <br />road and to the top of the pit. <br />4. The applicant proposes to mine the pit slopes at a 2hav and 3hav. Razely does the Division see this <br />mining practice occur due to the difficult nature to mine in this fashion. Typically, the Division <br />observes slopes that aze mined at 1.Shav. Please further explain how the operator will mine at these <br />slopes. <br />5. The applicant proposes a processing plant, an asphalt batch plant and a concrete plant on the site. <br />Please state if any ponds will be built to facilitate these stmctures. In addition, please state how the <br />structures will be constructed and maintained to minimize impacts to the hydrologic balance. <br />6.
