Long <br /> <br />FROM: <br />Erica Crosby Q Division Dneaor <br /> Larry Routten <br />RE: Yoast Mine (C-94-082) <br />NOV C-96-018 <br />Extension of Abatement Deadline Beyond 90 Days <br />Please find attached, Seneca Coal Company's request to extend the abatement deadline beyond <br />90 days for NOV C-96-018. The violation was issued November 26, 1996. The current <br />abatement deadline for the NOV is Februazy 22, 1997. Abatement requirements include submittal <br />of a reclamation plan addressing the disturbance associated with RCR 27a, and implementation <br />of the designs approved by DMG. The reclamation plan was submitted to the Division on <br />January 13, 1997. The Division has contacted Routt County requesting their comments on the <br />reclamation plan of RCR 27a. The Division is waiting for a response from the County prior to <br />approval of the reclamation plan. <br />Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension of <br />the abatement of deadline beyond 90 days. Seneca has timely submitted a reclamation plan for <br />the disturbed azea. The Division is waiting for a response from Routt County which will go <br />beyond the 90 day abatement. Weather conditions will also hinder the reclamation of the <br />disturbed azea once the plan is approved. <br />Based on this information, I recommend that you approve the 90-day extension to May 23, 1997. <br />Enclosure <br />c:\wp51 \misc\970221 <br />
