Our responses follow as per the original <br />question number. <br />Response accepted <br />2. Response accepted <br />As you are aware, NPDES sampling requirements do not replace <br />or preclude DMG water monitoring program sampling <br />requirements. Based on your response, Spring No. 1 should have <br />been measured for flow and a sample should have been collected <br />for full suite analysis, but apparently was not. Spoil spring <br />monitoring at the Edna mine is of keen interest to the <br />Division due to the proximity of the mine to Trout Creek. <br />This single, full suite annual sample provides the Division <br />important data with regard to spoil spring water quality and <br />potential impacts to Trout Creek from spoil springs at the <br />Edna mine. Review of the monitoring program in effect at that <br />time reveals that page 4.6-145 of the permit clearly states <br />" ...Flow from a spring or seep exceeding approximately 20 gpm <br />will be noted" and "...a sample will be taken from the larger <br />(exceeding 20 gpm) springs and seeps and a full suite analysis <br />performed on that sample to characterize the type of flow". <br />Based on this monitoring omission the Division has issued an <br />enforcement action (attached). You have 15 days from the date <br />of issue to submit written documentation with regard to the <br />facts of the violation. <br />The Division will be conducting a review of the data to determine <br />
