If the Division agrees to do so, please <br />accept this letter as a further request on behalf of Ann Tatum to withdraw, without prejudice, her <br />citizen complaint regarding current subsidence damage to the residence house at Solitario Ranclt. <br />Upon reconsideration ofmatters, the Tatums believe that the more efficient method of pursuing their <br />claims against IIasin 1'or continuing subsidence damage to their propeny is the prosecutirni of a civil <br />action under § 34-33-135(6) of the Colorado Revised Statutes nr under common law causes ul' <br />action. In the Tatums' view, Colorado law provides them with both administrative and.judieial <br />remedies f'or subsidence datttage, and they have determined that pursuit ot'their judicial remedies <br />is the more appropriate course of action. <br />Please let me emphasi2e that the Tatums request vacation of Notice of Violation No. CV- <br />2000-009 only if the Division does so without prejudice to its authority to issue a replacement <br />notice of violation in response to a renewed adrninistretive enforeementrequest inthe fuhtrc. Such <br />a request is highly unlikely, but unforeseen developments may require the Tatums to renew their <br />pttrsuit of administrative relief, and thry do not advocate any measure that would i'oreclose their <br />opportunity to do so. <br />The 'Tatums wish to make clear that in requesting vacation ofthe currant notice of violation, <br />they express no dissatisfaction with the Uivision of Minerals and Geology in its response to Ann <br />Tatum's citi~ett complaint or its actions during administrative review proceedings to date.
