SHELTON, Director <br />DATE: June 8, 1987 <br />T0: Twin Pines File <br />FROM: Jeffrey Deckler <br />RE: TWIN PINES NO. 2 HAUL ROAD, FILE C-83-053 <br />Asa result of Ten-Day Notice 87-02-006-003-TV-2, the Division has <br />investigated the interaction between the operator and Fremont County <br />concerning the mine haul road. Based on conversations with Chris Reed, Joe <br />Carpine of Twin Pines and Wesley Carhart of the County Commissioner's Office <br />on June 4 8 5, 1987, the following comments and conclusions may be made: <br />The Twin Pines haul road was an existing county road prior to permitting of <br />the mine. <br />2. Twin Pines agreed to upgrade the county road for use in their mining <br />operations. It was further agreed that after a period of one year <br />following the upgrade, the county would assume control of the road, <br />including all associated maintenance responsibilities. <br />3. The county has currently taken over these responsibilities as per this <br />agreement. <br />4. The county had assumed that when they took over the road, it would be <br />removed from the Twin Pines boundary. However, Twin Pines has never <br />submitted a revision to delete the area. The Division advised the <br />operator of the need to submit this revision to clear up the matter. <br />5. The county expressed no concern that the as-built road was somewhat <br />different for the design.
