Box 591 <br />Lamar; Colorado 81067. <br />Re: Valco, Inc., "Lamar West Pit"; Prowers County, File No. 81-132 <br />Dear Mr. Gregg: <br />Enclosed is the inspection report reflecting the April 17, 1985 inspection by <br />Camille M. Farrell and Bradford L. Janes. - <br />_ As previously mentioned, the failure to salvage topsoil constitutes a possible <br />_ violation. Therefore, dur-ing the April 24-25, 1985 meeting of the Mined Land <br />Reclamation Board, the Board will consider whether or not there is reason to <br />believe a violation of permit number 81-132 and/or the Mined Land Reclamation <br />Act has occurred as a result of the failure to salvage topsoil, as described <br />in the report of our April 17, 1985 inspection. If the Board finds that there <br />is reason to believe a violation has occurred, the matter will be set for a <br />Formal-Public Hearing (most probably during the May 22-23, 1985 meeting) to <br />consider a possible Notice of Violation, possible Cease and Desist Order, <br />possible corrective actions for the violation, and possible civil penalties <br />against you for any violation found. You would _receive at lease twenty days <br />notice_of any such formal public hearing. <br />The Board meeting will be held in Room 110 of 1313 Sherman Street, Denver, <br />_ commencing at 9:00 a.m. each day. You may call our office during the period <br />of April 22-23, 1985 to get amore specific day and time that this matter will <br />be heard. Since an actual violation cannot be found until after the Board <br />finds "reason to believe", y.ou may or may not wish to attend this April <br />meeting. However, you should plan to be represented at the May 22-23,1985 <br />formal public hearing, if such a hearing is scheduled by the Board.
