One of the central
issues for the Board to decide will be whether the Division appropriately issued the NOV,
given the fact that Four Corners Materials is the owner and responsible party for the
culverts in question. As the abatements require Oakridge to modify the Cazbon Junction
permit to include the culverts covered under the Ewing Mesa permit as well as maintain
or remove property of another company, it would seem prudent to allow the Boazd to rule
on these issues prior to requiring Oakridge to complete the abatements.
We would request that the abatements be extended for 30 days past the Boazd hearing
decision date.
Since ,
~-
Michael S.
