I have been involved
since that time in reviewing Colowyo's designs for the Prospect
Pond, West Pit Pond, Section 16 Fill and associated structures.
This matter is still unresolved. Most importantly, the operator
has not submitted final hydrologic designs for these structures.
i do not consider that the Division has approved demonstrations
related to these structures to be placed into the permit.
In the interim since 1991, the Prospect Pond, Section 16 Fill and
associated structures have been built. Several structures
associated with the Prospect Pond and Section 16 Fill (the South
Collection Ditch, windrowed topsoil stockpiles and Section 16
Ditch) have recently failed in their operation and have become the
subject of notices of violation.
I believe that the burden of blame for lack of approved
demonstrations and for the Failure of the structures, mentioned
above, lies with the operator.
