Walther
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
The Division of Minerals and Geology has received your application for the Platte Sand and Grave S & H Mine
Technical Revision (TR-02). The revision request changes the mining plan for the site from wet mining to dry mining,
and includes the installation of a slurry wall, changing the previous, approved reclamation plan from groundwater akes.
The Division believes that the changes contained in your technical revision application (TR-02) are extreme enough to
merit that the material be submitted to the Division in the form of a permit amendment. Therefore, the Division is
denying your request for Technical Revision (TR-02). Ifyou disagree with this decision, you have the right to appeal
the decision to the Mined Land Reclamation Board. Ifyou desire to appeal the Division's decision, section 1.9.2 ofthe
Construction Materials Rules and Regulations allows for the Applicant to appeal the decision. In order to appeal the
decision, you must submit a petition for a hearing pursuant to the provision of Paragraph 1.4.11 of Construction
Materials Rules and Regulations.
Ifyou have any questions regarding this issue, please contact me at (303) 866-4935.
Sincerely,
/ ~~~ ~~" ~
~/ H.
