Broetzman, Director RECLAMATION DIVISION <br />Water Quality Control Division <br />Colorado Department of Health <br />4210 E. 11th Avenue <br />Denver, Colorado 80220 <br />Subject: In the Matter of Snowmass Coal Company, North Thompson Creek <br />Mine NPDES Permit No. CO-0029599, Pitkin County, Coloraro <br />Dear Mr. Broetzman: <br />This letter constitutes Snowmass Coal Company's ("Snowmass") response to <br />paragraphs 2 and 4 of the Cease and Desist Order issued on August 1, 1986, <br />with respect to the reference permit. Snowmass intends to comply with the <br />Order to the extent the Department of Health has jurisdiction, to the extent <br />that the Order and the accompanying Notice of Violation are finally determined <br />to have been validly issued, and in accordance with the terms of the Order <br />and NOY as they are finally determined to be valid. Snowmass intends to <br />cooperate with the Division and the Mined Land Relamation Division, which <br />issued its NOV No. C-86-051 on June 17 for the same condition, to resolve <br />this matter in a fashion satisfactory to all concerned. <br />With respect to paragraph 2 of the Order, Snowmass has already provided the <br />detailed statement of the measures taken to comply with paragraph 1 of the <br />Order in our letter of May 19, 1986, to Sandy Squire of the Division. The <br />only additional information that needs added to the response is that subsequently <br />received laboratory results showed compliance for total iron in the discharge <br />from outfall 001 was achieved on May 16, 1986.
