C-80-001 <br />RESPONSE TO'APPLICATION FOR FORMAL REVIEW AND <br />REQUEST FOR EVIDENTIARY HEARING <br />The Pittsburgh and Midway Coal Mining Company (P&M) has <br />submitted an application for formal review and request for evi- <br />dentiary hearing on Notice of Violation (NOV) C-93-026. The Di- <br />vision responds as follows: <br />1. Susan Burgmaier of the Division conducted an inspection <br />of the mine site March 30 through April 2, 1993. During that <br />inspection, Ms. Burgmaier found that culvert E-12 was blocked, <br />that a slurry of mud and coal fines had discharged from the cul- <br />vert outlet onto previously reclaimed East Ridge areas. In addi- <br />tion, on the east side of the shop pad, coal had been pushed over <br />a berm onto an undisturbed area. Furthermore, in the location of <br />the grizzly pad, coal had been placed outside of the drainage <br />control area. <br />
