Natural Resource rn,stee <br />Deaz Mr. and Ms. Van Ella: <br />I apologize for not answering your letter of November 6, 2005 (with a copy of the letter dated September 26, 2005) <br />that we received on November 9, 2005 sooner. I have recently been out of the office. <br />In your letter dated September 26, 2005, you stated that at the time you first obtained your permit you were chazged <br />the wrong amount. I have checked the records and you were chazged the same amount as everyone else who <br />obtained a limited impact permit at the time or $875.00. However, you were subsequently charged the annual Fee of <br />$75.00 per year when the fee should have been $225.00 per year. We are not asking for any of these unpaid <br />moneys. <br />The Division of Minerals and Geology (Division) cannot supply you a letter to Chaffee County stating that we erred <br />in approving your permit in 1992 since we did not err when reviewing and approving your permit. The DMG <br />cannot dictate to an operator how many acres are contained in a permit area. The amount of acreage included in a <br />permit azea is completely up to the operator so long as the total permit area for a limited impact operation is less <br />than 10 acres. The application that you filled out and submitted to the Division in 1992 requested that your permit <br />azea be 3.0 acres. After review, the Division approved the application and supporting documents. <br />I am also not awaze of any "agreement" that we would send any sort of letter to the county since we never have done <br />this and would be remiss in our jurisdiction if we did. I do recall stating that, if you filed a technical revision to the <br />permit changing the reclamation plan that this could help in bringing the actual on the ground conditions into <br />compliance with the reclamation bond and may make it so that no mare bond money would be needed at this time. <br />As you know, that technical revision has been filed and approved, the Division has recalculated the bond and no <br />more bond is needed at this time. <br />If you have any questions or need further assistance, please contact me at 303-866-3863. <br />Si ely, <br />Carl B.
