Construction <br />Company regarding the above allegations made by the <br />Colorado Mined Land Reclamation Division. I have <br />reviewed the relevant statutes and regulation. I <br />concur with your opinion that the State of Colorado's <br />attempt to penalize your client and the New Mexico <br />State Highway and Transportation Department for failing <br />to obtain a reclamation permit for use of a surfacing <br />pit owned by Demetrio Valdez in 1984 and 1985 is barred <br />by Colorado's Statutes of Limitations. <br />The New Mexico State Highway and Transportation <br />Department is not planning on attending the hearing for <br />the Colorado Mine Land Reclamation Board the week of <br />February 24, 1992.
