Hernandez <br />Division of Minerals and Geology <br />1313 Sherman St. Room 215 <br />Denver, CO 80203 <br />RE: Notice of Violation No. C-93-087 <br />Request for Abatement Extension <br />Raton Creek Mine -Permit No. C-82-055 <br />Dear Mr. Hernandez: <br />(303 623-83 t 7 <br />twx 910-931-2561 <br />RErENED <br />AUC~ 91993 <br />LtiviSiOn Ot AMin2rals a Geology <br />With this letter Energy Fuels Mining Company (EFMC) hereby requests an extension of time for abatement <br />for above referenced Notice of Violation No. C-93-087. <br />Reouired Remedial Action: 1) Install approved sediment control structures, 2 and 3) Submit new designs <br />for sediment control that captures all surface drainage and treats it prior to leaving the permit area, or <br />retains it on site within anon-dischazging facility, and 4) Implement new designs within 15 days following <br />TR approval. <br />Current Abatement Status: EFMC is submitting a complete request for bond release for the Burlington <br />Northern (BN) loadout azea (letter dated July 28, 1993). Based on the reclamation work ddue at the BN site <br />and the current post-mining land use, EFMC believes that requirements for a sump are no longer applicable. <br />[^ addition, EFMC is preparing revised sediment wntrol plans for the Santa Fe loadouts to fully abate above <br />steps 2 and 3. <br />The required abatement date for Steps 1-3 is August 9, 1993. Based on time required to review the proposed <br />BN bond release application ,and review, approval and implementation of proposed revision to Santa Fe <br />sediment control, EFMC is requesting extension of the abatement date for NOV C-93-087to September 8, <br />1993. <br />Please contact me if you have any questions or require additional information wncerning this request. <br />Sincerely, <br />~CJ~°~ <br />Allen S.
