Cattany <br />, Division Director <br />K i / f E/(Jatural Resource Trustee <br />Re: Clarification of an Objection Letter, Conversion Application, CN-Ol, Ula Pit, M-1991-083 <br />Deaz Ms. Fay: <br />The Division received your July 28, 2004 objection letter regazding the Ula Pit conversion <br />application. The letter was received on July 28a', the last day to submit objections, so it is <br />considered a timely objection pursuant to requirements of Rule 1.7. It describes various reasons <br />why you feel you will be adversely affected or aggrieved and you have signed the letter. Since <br />you have complied with Rule 1.7, you will become a Party to the action. The Division will set <br />the matter for a hearing before the Mined Land Reclamation Boazd according to provisions of <br />Rule 2. Apre-hearing conference shall be scheduled as soon as possible in compliance with Rule <br />2.7 procedures. <br />The letter also contains an attachment listing other possible objectors. However, the possible <br />objectors did not sign the letter (if they feel aggrieved or adversely affected for the same reasons <br />as you do they must acla3owledge it by signing the document) nor did they describe any new <br />reasons why they would be aggrieved or adversely affected by the conduct of this proposed <br />revised mining operation. <br />In order to become a Party to this action the possible objectors need to outline their own specific <br />reasons why they would be adversely affected or aggrieved by the conduct of the proposed <br />mining operation or agree to the reasons outlined in your letter. They must sign the document so <br />it is clear that their intent is to object to the applicant's proposal to convert the existing permit to <br />a 112 Regulaz permit. <br />Those who aze listed on attachment number 1 will become Parties to this action as long as they <br />follow the above noted instructions. Signed objection documents must be submitted to the <br />Division rather quickly so all Parties can be notified of the pre-hearing conference schedule and <br />the date(s) of the Board hearing. <br />If there are any other people, not listed on attachment 1, that wish to become Parties to this <br />action they must petition the Board for party status during the hearing since July 28, 2004 was <br />the last day to submit written objections. <br />If you have any questions, please call Mr. Harry Posey, Senior Environmental Protection <br />Specialist, at 303-866-3927. <br />OfFice of OfFce of Colorado <br />Mined land Reclamation Attive and Inactive Mines Geological Survey <br />
