Long <br />Division Dveaor <br />Re: Virginia Acres, M-90-021, Submittal of Notice for Imported Soil Fill Pursuant to Rule <br />3.1.5(9), and Corrective Action Completion. <br />Dear Mr. McGehee, <br />The notice you submitted to characterize the soil fill that was placed at Virginia Acres, pursuant <br />to the requirements of Rule 3.1.5(9), has been reviewed. The type and volume of material would <br />make it seem a logical and benign activity to place it there for permanent onsite use. Importing <br />materia; to a permitted site, however, necessitates prior provision of such notice. The notice <br />you provided clearly explains the circumstances of such placement of fill, and how it will be dealt <br />with onsite. <br />The infi3rmation satisfies the requirements of the notice. Additionally, because the submittal was <br />for the i~urposes of correcting a problem, and was found to be complete and submitted by the <br />corrective action date, the problem noted in the 4/29/98 inspection report is considered to be <br />corrected. <br />The fin~mcial warranty presently posted for this permitted operation is $30,000. It will be deemed <br />to be sc.fficient at this time, at least until the reclamation costs have been recalculated. Tlie <br />remaining reclamation seems to be limited to grading, weed control and revegetation. I am not <br />sure if Ilacement of a two-foot depth of soil will do more than slow down the knapweed, but it <br />may allow a short period of no competition for your seeded grasses. <br />Because the soil is from a nearby site, the soils are probably similar to those naturally found on the <br />permit ltrea. Therefore, a revised seed nux and/or revegetation plan will probably not be needed. <br />If you gave difficulty establishing the revegetation, you may have to take a sample and have it <br />analyzed. If a change is needed, please contact us so that we may discuss the change. <br /> <br />
