Step 3 in the <br />modified NOV requires that a plan be submitted to temporarily stockpile low <br />quality coal ("underground development waste") at the Mt. Gunnison Mine. In <br />accordance with that order, West Elk Coal Company (WECC) proposes to <br />temporarily stockpile low quality coal in the area known as the "U. S. Steel <br />Laydown" area. Redisturbance of that Laydown area was approved in a recent <br />technical revision to WECC's Permit-to-mine C-007-80. That revision is <br />incorporated by reference in this letter. Although we request immediate <br />approval to use the entire area for stockpiling this material, it is our <br />intention to use only approximately two acres of the area. The remainder will <br />be used as a Laydown area for construction material. WECC proposes to <br />stockpile low quality coal in this area until such time as the material can be <br />disposed of in the area described as the Upper Waste Rock pile in the Mt. <br />Gunnison Mining and Reclamation Plan or until other appropriate disposition of <br />the material can be arranged. <br />Prior to stockpiling this material on the U. S. Steel Laydown area, WECC will <br />remove all vegetation and topsoil. The topsoil will be stockpiled as <br />described in the above-referenced technical revision. Sediment control <br />structures for the area will be constructed prior to stockpiling the material <br />and as described in the above-referenced technical revision. The pile will be <br />wheel-compacted and graded to ensure adequate drainage. Bonding and <br />reclamation of this temporary storage area will be described in the <br />application to revise the Mt.
