Catlany <br />Division Director <br />Grand Junction, Colorado 81502/ B%aY Na[ural Resource Trustee <br />RE: Soaring Eagle Gravel Pit, Permit No. M-1999-0251 Technical Revision No. 2 Approval and <br />Reclamation Cost Estimate Recalculation) ~,/ ~ <br />Dear Mr. Settle: <br />DMG has completed review of the Technical Revision No. 2 (TR-02) application to Permit No. M-1999- <br />025 for the Soaring Eagle Gravel Pit. The application for TR-02, addressing mining and reconstruction <br />of a portion of the large island, is hereby approved. This approval includes planting of a minimum of 5 - <br />2inch caliper cottonwood trees on the island as we agreed to by phone on November 30, 2005. <br />The reclamation cost estimate (enclosed) incorporates the island reclamation provisions in the highwall <br />figures and includes costs for the increased facilities area acreage, as well as an update of the original <br />cost estimate calculations. Highwall and facilities area acreage were calculated from the 2005 annual <br />report map. The enclosed estimate also includes costs for engineering and installation of an inlet <br />structure. This inlet construction cost is now required due to completed excavation of a portion of <br />Phase V with a commitment in the permit stating that mining of Phases V, VI and VII would not take <br />place until engineering design and bonding for this structure was approved by DMG. The inlet <br />construction is estimated based on costs of constructing the outlet structure. The inlet construction <br />costs are temporary and will be recalculated upon submittal of engineered designs. The revised <br />financial warranty amount must be submitted prior to mining of the island. <br />Additionally, the mine plan map must be updated to delineate the larger facilities area, the north side <br />perimeter road, the expanded wash plant settling pond, new mine phase sequencing and the revised <br />wetlands area. An explanation of the revised map must be included with the submittal along with <br />results of the wetland study that documents the actual wetland acreage to be affected by the mining <br />operation.
