Existing Bond: none <br /> Park County <br />Nature and Duration of Violation: <br />The operator explained in a letter dated February 9, 1995 that the <br />County had recently discovered through an internal audit, that <br />this operation did not have a State reclamation permit. They <br />stated that their staff had been notified of this problem and <br />expressed their desire to work with the Division to resolve the <br />matter. <br />On March 17, 1995, the Division received a complete 110(2) permit <br />application for this operation. <br />This pit is located about 20 miles southeast of Hartsel, Colorado. <br />The land is owned by Park County. The County has operated this <br />pit on an intermittent basis for the past few years. <br />The operation was inspected by the Division on April 20, 1995. <br />On-site disturbance included a pit with sloped 20' to 25' walls <br />and about 4,000 yards of screened topsoil and fines sufficient for <br />reclamation of the on-site disturbance. There was no equipment in <br />the pit and no mining activities were being conducted. The total <br />disturbance is approximately 4 acres. <br />seriousness: Zones <br />0-2 Acres 2.1-9.9 Acres 10+ Acres <br />$3,000 $9 000 $60,000 <br />History of Violations in Past Twelve Months: None <br />Staff Recommendation: <br />Violation: Find a violation of C.R.S. 34-32-109(1) <br />and (2) for mining without a permit. <br />Cease and Desist: None Recommended <br />Corrective Actions: The 110(2) permit application was <br />approved by the Division on April 24, <br />1995. <br />Civil Penalty: $9,000 based on 2.1 to 9.9 acres <br />disturbed. Because this was discovered <br />through an audit and was brought to the <br />Division's attention by the operator, the <br />Division recommends that no civil penalty <br />be assessed. <br />
