Oswald: <br />As your memorandum of October 17 indicates, there are selveral <br />jurisdictions involved in the above referenced matter indluding the <br />BLM, the Department of Health, Gunnison county, etc. <br />;•~e believe we are in substantial compliance with the Cease and <br />Desist Order in that the following actions have been take: <br />:`.sphalt is removed from site <br />Corrective Action Plan has been submitted to Health Department along <br />with response to their request for additional information <br />Discussions have been ongoing with the ELP"_ <br />It is my understanding that the BL:D' is agreeable to working out an <br />easement for the power pole and part of the roadway afteri the <br />remediation work (which must first be approved by the He alth Dept). <br />As you are aware, we have diligently attempted to resolveithis matter <br />with as little delay as possible. <br />Enclosed is our check in the amount of $2,500.00 which islthe civil <br />penalty proposed in the Cease and Desist Order.
