M-95-062, Civil Penalties, and Cease and Desist Order
Dear Mr. Trites:
C.R.S. 34-32-116(3) and (4), 1989 Supp. and Permit No. M-84-013 require y u to submit to
the Division of Minerals and Geology $225.00 in annual fees and an annual~eport on or
before May 14th of each year. As of the date of this letter the Division has n t received your
annual fee and report for May 14, 1995. Therefore, you are in Violation of tie above cited
statute and the provisions of your Permit No. M-84-013. Pursuant to C.R.S. ~4-32-124 the
Mined Land Reclamation Board hereby assesses Notice of Violation No. M-9~-062, Civil
Penalties in the amount of $225.00, and Notice and Order to Cease and Des~st from ALL
mining related activities associated with Permit No. M-84-013.
NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANT~D TO ANY
OPERATOR WHO IS CURRENTLY FOUND TO BE IN VIOLATION IN THIS TATE
(C.R.S. 34-32-120) UNTIL THE VIOLATION IS ABATED.
If you fail to submit your annual fee, annual report, and the Civil Penalties a sessed to the
Division by October 18, 1995, this matter will be heard at a Formal Public Baring before the
Mined Land Reclamation Board for consideration of permit revocation, forfei ure of your
financial warranty Certificate of Deposit No. 691-8654 in the amount of $1, 0.00, at the
October 19, 1995 Board Meeting. If you submit all past due annual fees, re orts, and the
Civil Penalties by October 18, 1995, this matter will be withdrawn from Boa~d consideration.
IN ORDER TO AVOID PERMIT REVOCATION AND BOND FORFEITURE, P EASE SUBMIT
$225.00 FOR ANNUAL FEES DUE AND $225.00 FOR CIVIL PENALTIES (F R A TOTAL OF
$450.00), AND YOUR ANNUAL REPORT BY OCTOBER 18, 1995.
The Board Meeting will be held on October 19, 1995, in Room 318 of 1313 Sherman Street,
Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter can be
considered, and you will have the opportunity to be represented and heard.
