A9iriera~s tc Geology <br />c/o Colorado Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Request for Declaratory Order on Sediment Traps at the Meadows ti 1 Mine (file C-81- <br />029) <br />Dear Mr. Danielson: <br />Pursuant to CRS 24-4-105 and Rule 1.14(1), Sun Coal Company is petitioning the <br />Colorado Mined Land Reclamation Board for a declaratory order to address <br />uncertainties as to the applicability of a rule within the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining. <br />In requesting this declaratory order, Sun Coal believes the Board should consider the <br />issues surrounding this issue since a ruling on this petition will remove uncertainties as <br />to the applicability of a rule to Sun Coal, this petition does not address a question or <br />issue which is currently the subject of a formal or informal matter or investigation <br />before the Board, the petition addresses a real question of regulatory interpretation, and <br />finally, Sun Coal does not have any other adequate legal forum for addressing the issue <br />contained in this petition for declaratory order. <br />Pursuant to Rule 1.14(4) Sun Coal Company provides the following information. <br />Petitioner <br />Sun Coal Company, 10200 W. 44th Ave., Ste 120, Wheat Ridge, Colorado 80033 is <br />the petitioner for the declaratory order. Sun Coal Company is a permittee under the <br />Colorado Surface Coal Mining Reclamation Act, holding the permit for the Meadows <br />No. 1 Mine, CDMG permit C-81-029. <br />
