Dear Mr. Self:
The undersigned, Helen Christine "Nell" Eldridge, individually
and on behalf of the Trust established in that certain
Irrevocable Trust Agreement dated August 12, 1976 and recorded
as Document No. 276175 in Book 491 at Page 973 of the Garfield
County records, of which I am a trustee, state that the Trust
and I own the surface and mineral interests in certain lands
located near the Harvey Gap of the Grand Hogback, including:
the Sy:NWY. and the Ny:SWy., Section 19, T. 5 S. , R. 91 W. of the
6th P.M., the NEy.NEY., Section 23, T. 5 S., R. 92 W. of the
6th P.M.; and all of Section 24, T. 5 S., R. 92 W, of the
6th P.M., except the tracts of land numbered 1, 2, 3, and 4 as
more particularly described in certified copy of Order, Rule,
Judgment and Decree in condemnation recorded in Book 321 at
Page 270, Reception No. 207196 on October 28, 1959, in the
office of the Garfield County Clerk and Recorder, containing
2.92 acres, more or less, and except a tract of land 300 feet
by 700 feet in said Section 24 as practicularly described in
deed recorded in Book 25 at Paqe 239 of the Garfield County
records, containing 4.82 acres more or less. We have entered
into a lease agreement, dated October 15, 1982, with Western
Associated Energy Corporation under which Western, through its
wholly-owned subsidiary, Eastside Coal Company, Inc., currently
operates an underground coal mine known as the Eastside Mine.
That lease remains in full force and effect, and I am unaware
of any default by the lessee.
I understand that you ace applying for a special use permit to
continue operation of the Eastside Mine. By this lettec, I am
authorizing Eastside Coal Company, Inc. to obtain that pecmit
in Eastside Coal Company's name.
