Although Snowmass c+as uncertain of its respon- sibility- in this matter, steps were immediately taken to deter- mine the source of the seeps and to intercept r.he water before it flowed into North Thompson Creek. Some background information on this matter may- assist. ~-ou in Four review of this situation. During Mai- 1.9$6 Snowmass had a noncom- pliance discharge from out.fall 001. This noncompliance discharge C P.SlII t. P_d in Snowmass heine issued a Notice of l'i ola t.ion and Cease and Desist Order Dated ,lugust 1, 1986. This Notice of 1'iolat.ion and Cease and Desist Order and hlined Land Reclamation Uisision's Nnt..i.r_e of ~iolat.inn were both settled b~- and Agreement., St.ipula- t.ion and Order which ~:as exer,uted during December 1986 and January ]987. As part of the settlement agreement Snowmass agreed to redesign the seals for the No. ] Kline. 'l'he seals c:ere t.o be designed to present leakage or flow of water from under- ¢round to the surface through the pnrt.aLs and were to be in- stalled in accordance with designs and plans approsed by MLRD as a revision to Snowmass' hlining Fermit. By letter dated October 5, 1987, Sno~:mass requested a modifica- tion to its CDFS Fermit to eliminate discharge point, OU1 beCaUSe the design of water tight. seals for the No. 1 Kline was approved by MLRD on Pla~• 28, 1987 and i.nstaLlation of the seals i:as com- pleted in .h11y 1987. Snowmass subsequently received approval from the Department of Health to eliminate discharge point 0111.
